Just to reiterate, I am all for doing something about distracted driving from cell phone use. But using it as a pretext for fishing expeditions as well as raising revenue all the while making roads less safe is only able to be justified by the type of government we have nowadays.

That is as sad as it is irrational. I have no problem with personal liberty. What about the right to life of the person they will kill? Someone's wife, husband, son, daughter senselessly killed because Brooklyn thinks it infringes on personal liberty to call DWI a crime unless someone is killed or injured.

I'm not sure how much I buy into the no hands on the wheel. It is hard to drive a considerable distance with no hands. I would bet the guy had a cell in one hand, and his other hand was on the wheel at 5 or 7 o'clock, and the cop couldn't see it. Doesn't really matter anyway. I just have a hard time believing cops most of the time. Ever get pulled over late at night for "swerving"? Fish enough times and they are going to hook something eventually.

I think his whole point was that when the drunk driving law was inforced and worked They needed to lower the limit to .08 because the number of arrests, interactions, convictions, etc dropped. About money? unlikely. About power? possibly!.
I am not entering this thread with my opinion, just hopefully someone that understands what he's trying to say.
So it leads to the question of would the law makers make laws purposely to have more control over the public or in order to more protect the public? What have the law makers in MD been doing?
Then the charge should be reckless driving. And if they can make the case on the elements I have no issue. I am skeptical that that is exactly what happened. The net effect of the cell phone law is to create a non rebutanble presumption that cell phone use is reckless. The actual accident numbers do not bear that out.
Reckless driving is not a new charge and its not a new problem.. why is new law needed... my answer is part political and part pragmatic.. it weakens the standard of proof that the state need s to make. I expect that the evidence may support such a charge.
But I may very well not... make a charge of reckless and prove it.
I expect that by the time this gets to court the story will be even more grandiose...
But I do not know.. maybe we will have a solid offer of proof.. that's rare in tragic court.
