    Yet that's what its evolved into. That said, perhaps the best way to deal with this reality would be to make SCOTUS seats chosen by the people in four or six year terms with TERM LIMITS. Just a thought....

    I agree on term limits, longer for supreme Court justices though, but not on the justices being directly elected by the people. NO WAY.

    We do not need our high court to bombarded by the ridiculous lobbyists, special interests, and donors seeking favors, as we see happening with most Senators and other directly elected officials. The justices of the supreme Court are not meant to be direct representatives of the people, they are only there to review appeals, and to 'interpret the Constitution' when necessary. That's it. Justice Scalia was the perfect example of a Justice honoring his very limited power.

    At the time of this country's founding, political service was an extraordinary sacrifice. It wasn't a means to a 50 year "career" spent selling out one's fellow Americans for their own ease and enrichment. Things have obviously changed quite a bit since that time.

    In August 1960, the Democrat-controlled Senate passed a resolution, S.RES. 334, “Expressing the sense of the Senate that the president should not make recess appointments to the Supreme Court, except to prevent or end a breakdown in the administration of the Court’s business.”

    Given the caveat, I'm sure they'll still try ...

    But I have no doubt whatsoever that the Muslim-in-Chief will capitalize on Scalia's death any way he can.
    As will CA9 to kill Peruta. Gun cases being slowed down in the Federal courts will no doubt experience a sudden rush of speed to get them to SCOTUS while there's a 4-4 tie.

    Something I haven't heard anyone talk about. With Scalia's passing, how do you think the other conservative judges react? I always thought that Scalia was the beacon for the other conservative judges to rally around. Without him, do you think the others may start leaning towards the middle? Will they dig in their heels in honor of Scalia?

    Something else to think about, will Roberts forgo his vote to allow a majority ruling with the other 7 making the decision?

    Would it be possible for someone to withdrawal their case from SCOTUS until there are 9 members?

    Refusing to consider a nominee is a gamble and very possibly a bad one. The Republicans must defend a lot of Senate seats this fall and hope for the White House. If they lose the White House, they can't hold out for 4 more years If they lose the White House and Senate then the sky is the limit for the douchbaggery that will happen. The Dems will shut down the Senate and the government to get a vote.

    There is a way that Ofuktard can appease both sides, AND disrupt the R momentum.

    He could choose to blow up the R primaries and go with the obviously qualified Ted Cruz, or throw a wrench in the current investigations and put up Trey Gowdy.

    But, what do I know......

    I thought that was a "no no". At least that's what the Dems and Republicans said when Obamacare was working its way through. Wasn't Cruz villainized for "Filibustering"?
