Received letter today from BATFE regarding purchase from Diversified Machine

    I figured I would post this here to see if anyone else has received one of these letters recently from BATFE. I realize this is in open forum but my intention is to at least help others be aware of the situation.

    WARNING NOTICE

    YOU MAY BE IN VIOLATION OF FEDERAL LAW

    The Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) is responsible for enforcing Federal firearms
    laws. ATF has received information that you have acquired, or have attempted to acquire, one or more silencer
    kits/silencers or silencer parts from Diversified Machine/ https://diversified.machine.us, which have been determined to be silencers, none of which are registered to you in the National Firearms Registration and
    Transfer Record (NFRTR) as required by the National Firearms Act (NFA), Title 26 U.S.C. Chapter 53.

    This letter officially notifies you that it is a felony violation of Federal law to possess a.silencer that is not
    registered to you and that any silencer devices that are unlawfully possessed are subject to seizure and
    forfeiture by the Federal government. Possession of any of the unregistered silencer devices could result in
    prosecution for criminal violations of Federal law as well as potential State violations. Any future purchase

    or possession of such devices can subject you to prosecution as well.
    The Gun Control Act, Title 18 U.S.C. Section 921(a)(24) defines the term “silencer” as:

    “any device for silencing, muffling, or diminishing the report of a portable firearm, including any
    combination of parts, designed or redesigned, and intended for use in assembling or fabricating a
    firearm silencer or firearm muffler, and any part intended only for use in such assembly or fabrication.”

    Title 26 U.S.C. Sections 5845(a)(7) & 5861(d) make it unlawful for anyone to possess a silencer as defined in
    Title 18 U.S.C. Section 921 that is not registered in accordance with the provisions of the NFA. Therefore, you
    cannot lawfully possess a silencer without first being a special occupational taxpayer and having the silencer
    registered in the NFRTR.

    Immediately contact your local ATF office at within 30 days of receipt of this letter to coordinate the
    abandonment of any silencers. Any future purchase or possession of such devices can subject you to
    prosecution as well.

    For the record I did purchase parts from Diversified Machine to complete a Form 1 suppressor. Once I received my stamp sometime in 2017 I ordered the parts. I had the tube Engraved at a local dealer and finished my assembly thereafter. All done totally by the book.

    I’m just trying to figure out the best method to respond. Send them a copy of my stamp and a photo of the suppressor? I guess if I need to pay my lawyer to send an official letter I could if it seems like it’s worth it.

    I’ve decided I’m going to reach out to an attorney and see if crafting simple response letter makes sense. If anyone else who is a member here in good community standing, and has received one of these letters AND had the proper NFA authorization to own these parts, pm me and we’ll chat response strategy in private.

    Nope I threw it in the scrap when I heard you all fvcked Diversified over. And since it hadn't been assembled or drilled it wasn't a suppressor and was disposed of as scrap metal.

    My guess is the fat-ass in charge of DM isn't doing due diligence. A simple cross-reference with purchase records and stamps should clear up anyone above board.

    But its easier just to blanket send a letter and report up the chain that action is being taken.

    Probably too much porn to watch to actually walk down the hall to get stamp information.

    Besides, they ran out of women and children to burn to death.

    Got mine this afternoon. Came here to see how many others got one too.

    I'm ignoring it as everything I did is legal and it just seems like they are just fishing. If the ATF would of spent 2 seconds just looking into who the sent these letters too, they would of found most are already in there system as responsible persons on trusts... probably saved quite a bit of our money on all that fedex postage and labor mailing all that shit out. But I guess that is less money out of their budget to spend trying to screw us over another way.

    I better make sure my dog doesn't run up to the door barking for the next few weeks now when someone knocks.

    Is the suppressor in your name or in a trust ?

    Looks like a form letter sent out to everyone in DMs customer database. I doubt they are gearing up to kick down the door of every person on that list. If they start addressing the letter to you personally and inquire on the wherabouts of a particular machined part you ordered, I would grace them with a reply.

    Personally, I might touch base with a lawyer. Reason being if the Batfe determined the kit was a silencer (before sale and purchase) it would require a form 4 to transfer and diversified would be the manufacturer (as opposed to you with a form 1). Not legal advice, but just a thought.

    Here is my suspicion:

    1.) some gangbangers or DREADED WHITE IDENTITY TERRORISTS OF DOOM were arrested and illegal unregistered suppressors made from form 1 kits were found in their possession.

    2.) AFT got a judge worked up enough to sign a warrant for them to seize customer lists from various form 1 manufacturers. In addition they did the thing where they confiscated assets and you have to use an expensive lawyer to get your stuff back, except it will take years and I sure hope none of this is used for your day to day livelihood.

    3.) The customer lists led to **** all that even the most 2A averse judge will sign off on arrest warrants for, so now the AFT is “doing something” by sending out warning letters after maybe comparing customer lists to the NFA registry (but probably not).

    4.) they used FEDEX because USPS sucks and they know it. As evidenced by at least two of my tax stamps getting lost in the mail by USPS.

    5.) they have now spent hundreds of thousands or millions of dollars to shut down like two form 1 websites and FedEx letters containing misspellings of certain websites to lord knows how many people, probably 99.9% of whom have broken no laws.

    6.) I hope a bunch of wealthy folk get together and sue the ATF so my wasted tax money at least goes back to private citizens.

    It was in a Trust. I actually filed it online the night before the June 2016 cutoff. Waited more than a year for the stamps. The trust is in my name and my home address so it should have been pretty easy to verify that I am legit. However, as others have stated this is a form letter sent out using a database generated mailing list.

    Many years ago I had a similar problem. I purchased a AMTEL chip programmer which were commonly used to pirate DirectTV. The company I purchased from was raided by the FBI and shut down. About a year later I got some serious threatening legal letter from DTV’s law firm. Thing is, we were using this legally to program access cards for work. I was personally also a paying Direct TV customer, including the premium NFL, and HBO package. I did send them a letter stating I was a DTV customer and I didn’t appreciate being hassled or threatened like this.

    I’m not sure how that would work with BATFE….
