Is there any particular reason it has to be a female instructor? Is being female considered a BFOQ?

Gotta be. It's not a strip club or a women's health organization, so I can't imagine the ability to justify being a female as a bona fide occupational qualification, or BFOQ.

Title VII of the Civil Rights Act of 1964:

t shall not be an unlawful employment practice for an employer to hire and employ employees, for an employment agency to classify, or refer for employment any individual, for a labor organization to classify its membership or to classify or refer for employment any individual, or for an employer, labor organization, or joint labor-management committee controlling apprenticeship or other training or retraining programs to admit or employ any individual in any such program, on the basis of his religion, sex, or national origin in those certain instances where religion, sex, or national origin is a bona fide occupational qualification reasonably necessary to the normal operation of that particular business or enterprise

    (Emphasis mine)

    Just my 2 cents...

I'm just trying to expand my business and there is a demand for female instructors. Some women have asked me if we have female instructors and because we don't, they went elsewhere. I'm not a huge corporation, just a sole proprietor of a Veteran-Owned Small Business.

While I applaud your interest in providing comfortable firearms training to reach more women, I suggest you delete your post and consult with an attorney familiar with employment law and discrimination claims before reposting.

IMHO advertising that you are looking for a female is no less unlawful than specifying a particular race, or religion.

    Good luck.

You could be a small veteran owned business in court being sued for lots of money you may not have. Your terms of employment are unlawful. I am former military LEO, have LEOSA credentials and was a firearms instructor for almost 20 years. If you wouldn't hire me for the sole reason that I'm a man you may have a problem. Pull you ad and get advice from the feds, state or a lawyer before you post something like this. What your asking for is no different than saying you must be a white male to be hired. Not good.

See nothing wrong with OP's ad. How do you think we got women into the military and on LE forces in the first place...they advertised for recruits and accepted only women...samo, samo. It's called diversity.

An employer cannot hire specifically for a certain sex, age, nationality or race.

Now, if an employer wants to mention in their hiring ad "Females encouraged to apply", that seems to be acceptable. Event hough everyone knows what it really means.
