    A state delegate from Prince George's County was arrested early Sunday for allegedly driving under the influence in Waldorf, the Charles County Sheriff's Office said in a statement.

    At 12:50 a.m., an officer driving in the 2700 block of Crain Highway saw a car exit a parking lot and fail to yield the right of way, causing the officer to swerve to avoid being struck. The officer pulled over the car and made contact with its driver, Del. Jewel Walker.

    The officer conducted field sobriety tests then arrested Walker, who was subsequently taken to the Charles County Detention Center and charged with driving under the influence, the sheriff's office said. Walker was released on his own recognizance.

    The Washington Post reports Walker, 48, has temporarily stepped down as vice-chair of the House's alcoholic beverages subcommittee. Walker, a Democrat, was first elected in 2006.

    A trial is set for April 16.

    There is a rendering of opinion by SCOTUS in the criminal law digest which does not allow such a cart blanche protection.

    Digest of Criminal Laws 2017 , Page 8.

    Granted it does say US House Members.

    Exemptions from Arrest
    Friendly foreign Sovereigns and their attendants, their Ambassadors
    and other diplomatic agents, public ministers and their attendants,
    household, and retinue are exempt from arrest, entry of their houses, or
    subjection to the process of law of the country visited.
    A member of the organized militia may not be arrested on any
    process not issued by a military authority while going to, remaining
    at, or returning from a place that the member is required to attend for
    military duty.


    Public Safety Article § 13-905
    United States Senators and Representatives shall in all cases, except
    treason, felony, and breach of the peace, be privileged from arrest
    during their attendance at the session of their respective houses, and in
    going to and returning from the same; and for any speech or debate in
    either house, they shall not be questioned in any other place.
    Article I, Section 6, United States Constitution.
    Editor’s Note: The Supreme Court has ruled on several occasions
    that the “constitutional freedom from arrest does not exempt Members
    of Congress from the operation of the ordinary criminal laws, even
    though imprisonment may prevent or interfere with the performance of
    their duties as Member”.

    583 (1972).
