    Hello, got a quick question about doing a secondary sale...

    I’m trying to sell a AR15 Lower receiver to a guy I volunteer with at the firehouse, but when he started doing the application, it asked for all of my info including my drivers license and social security number. Can I access his application to put it in privately (that’s not something I want floating around), or do I have to give him my information? This is my first time doing a secondary sale, so I’m a little unsure of what is needed on my end. If anyone knows the answers, I’d love to hear them. Thank you all and Happy Thanksgiving

    Yes, it needs to go through a FFL. MDSP is not doing them right now.

    The buyer will log in and start an application then you will both show up at the FFL with the lower. They'll finish the paperwork and hold the lower until he gets his "not disapproved" email 7 days later.

    If you live near Dubdalk, Bluefins is a great place for transfers.

    I thought AR-15's were treated as any other rifle/long gun in MD and could be sold cash and carry to any non prohibited person

    Has that changed?

    He is just transferring a receiver because it could be a pistol it’s a 77r transfer

    I think you’re right if it was a complete heavy barrel rifle it’s just a rifle

    My god MD gun laws are stupid. :sad20:

But if you included a bunch of other pieces that make it a functional firearm then it's not dangerous at all and does not have to be regulated." - This is what happens when legislatures who don't understand guns make gun laws.

    So when doing one at the MSP, does the seller complete the app there or does that info need to be completed prior to going to the barracks?
    Or
    If I was a buyer, do I get the sellers info and add it?

    The buyer has to complete the 77R before going to the office. The seller needs to get the info from the buyer and add it to the form. You can do it on a smart phone on the day you meet at the barrack if you want to.

    I just sat next to the buyer and he entered the info on his smart phone. I'm assuming even none HQL holders can set up an account in the Licensing Portal since the guy I am selling my pistol to has no HQL. (It's a C&R)

    You are correct. Non HQL holders can set up an acct. One acquaintance of mine purchased several C&R handguns and a couple lowers before getting his HQL to purchase modern handguns.

    Memory serves the one barracks transfer I did, the trooper on duty pulled up the application and entered the seller info as well as firearm serial, etc.

Also does the seller if he doesn't have an HQL need to establish an account? Reason I ask is that I have sold several regulated firearms through MDS and the buyers were established forum members and I did give them my info for the application. Even so maybe that was not wise but I have gotten inquiries on some guns by new members with zero posts (ie. no track record of posts that can give you some idea about them and how long they have been here).

    Obviously it's viewable by MSP. I'm not sure about the buyer. I'm not sure about the buyer, but once you fill out your part, MSP fills out their part (or the FFL) and submits it to MSP. But when I have bought a firearm via private sale, I have requested a receipt with the seller's name and address. SS# is not required to complete a sale on a 77R or a 4473.

    Yes, they need to have an account, there is no other way to log in without one.
