    No Standing for Texas to sue PA for their flagrant election law change

    So after Cert denial this one continued its battle in the lower Courts, specifically CA3 (NJ) & CA5 (W-TX).

    DD is still fighting NJ’s restriction of their files, originally in a suit with the NJ Atty Generals office. The NJAG transferred the case to the NJ District Court.

    Just now, the Fifth Circuit ruled that Defense Distributed's lawsuit against the New Jersey Attorney General should not have been severed and transferred NJ district court, saying this case involves "what appear to be flagrant prior restraints."

    Firearms Policy Coalition just won a Writ of Mandamus in the 5th Circuit against the NJAG.

    My questions for the legal minds…
    1. The NJ AG moved this to the NJ District Court, which then was ultimately denied Cert. Why was this case which was filed in CA5, allowed to end up on a failed CA3 path?
    2. This Writ of Mandamus, does this then keep it in the friendlier confines of CA5?
    3. If so, does this case still have “legs”? Where now?

    Well that is a total sh$$ show brewing and I would not be surprised if it ended up requesting cert before SCOTUS. The one judge who dissented in this case wrote a scathing dissent as well against the 2 judges who sided with Danial Defense.

    Now lets see if the District court of New Jersey will send the case back to TX or deny their request and keep it there in NJ. What could the TX court do if NJ gives them the middle finger and says no way, you had your chance and now its our turn?
