    Dick Heller sues D.C. over Ghost Gun Ban

    Patriot Attorney George Lyon is representing Dick Heller in a lawsuit against D.C. over their ban on homemade guns. As some of you may know George Lyon was a plaintiff in D.C.'s first carry lawsuit which overturned D.C.'s ban on carry and litigated the lawsuit which overturned D.C.'s ban on tasers. He currently serves as D.C.'s premiere firearms instructor when he is not practicing law. And of course Dick Heller is the man behind Heller v. D.C. As such really needs no introduction.

    I would dearly love to buy Dick a beer (or two).

    He's the most down-to-earth guy you can imagine. The late Rack introduced me to him, and he and I sat on coolers and ate a piece of fried chicken behind Fairfax County's barricades outside NRA HQ and talked about stuff. That was unexpected and delightful.

    Here he is chatting up some folks outside the Supreme Court with his disarming everyguy charm.

    This case is known as “HELLER IV” and is the 4th in a series of cases that began with the first Heller decision (“HELLER I”) in 2008.

    Dick created the HELLER FOUNDATION to continue to actively litigate these cases to restore our Second Amendment Rights, and is always on the lookout for:

    NEWS RELEASE
    For immediate release November 17, 2021

    Plaintiff Dick A. Heller reacts to the DC Council Amending its Ghost Gun Law in response to his lawsuit.

    Dick Heller (Supreme Court, 2008, D.C. vs. HELLER) said today he welcomes the District’s efforts to amend its so-called Ghost Gun law to address serious Constitutional concerns he and other plaintiffs raised concerning the measure.

    Pursuant to an emergency measure the DC Council passed on Tuesday, November 16, 2021, persons such as Mr. Heller will be able to build their own firearms as long as those firearms are marked with a serial number and kept for personal use.

    The District also amended its law on an emergency basis to comport with a federal provision relating to what it calls undetectable firearms.


    The District had drafted its original provision so broadly that it outlawed handguns constructed with polymer frames such as the Glock handguns DC issues to its police force.

    Mr. Heller explained that DC has registered thousands of such guns to its residents and apparently was unaware of the overbroad sweep of its law until it was sued. No other state had such a restrictive provision as DC had adopted Mr. Heller said.

    “Citizens who own Glocks and similar firearms should now rest easier that DC has come to its senses and tailored its law to comport with federal law with respect to these firearms,” he said.

    Mr. Heller went on to say that his lawsuit is not yet over.

    “DC only passed an emergency measure, it still has to permanently repeal the offending provisions, and I still have claim for monetary damages for the violation of my Second Amendment rights.”

    Dick Heller, in his own words, describes “Heller IV” and the other “Heller cases”:

    The “Heller IV” Second Amendment case was filed because municipalities continue to whimsically, yet creatively, create road blocks to our Constitutional Rights to be Armed.

    "Nothing in DEFENSE of your life is immoral."

    Mankind has always needed and had weapons: rocks, clubs, spears, slingshots, swords, bow & arrows, firearms, and beyond. We are supposed to be armed. There is no valid authority that can mandate one's weapon must come from a big factory.

    Keeping in mind the natural law, "anything to defend your life is moral," the “Heller cases” I, II, III and IV all fit the same pattern. In Heller I "I just wanted to keep the gun I owned to protect my household." The city said "NO."

    Repeat that 16 times for the number of elements in Heller II and Heller III. Heller IV is simply that I want to MAKE the next self-defense gun that I care to own instead of buying it in the store.

    We have no interest in violating federal law; I'm happy to put a "DH-1" serial number on it [helps in court cases] and, at the moment, register it.

    A person can build what they want in their garage: boat, furniture, car, firearm, airplane, anything else. City council members and legislators everywhere need to be held liable, personally, for these infringements.
