Transferring HBAR made from stripped lower between MD residents

    I know this thread has come up before, but the information in it is either very dated or the thread is just a mess after the first page. Admins- please delete if you feel i'm kicking a dead horse.

    I am trying to get some clear answers on how MD law views transferring of an HBAR in 5.56/.223 that was built from a stripped lower receiver (purchased as "other" and 77R).

    I am transferring to a very close friend of mine (not prohibited, MD resident, etc), so I'm really just looking to follow the letter of the law. If this was someone I did not know, I would certainly err on the side of transferring as a stripped lower.

    I've gotten mixed advice from a number of FFL's. Has anyone gotten any clarity on this? I know the laws may change soon, so I am asking about things in it's current state.

    My understanding is that MD police require FFL's to treat stripped lowers as regulated, but they are not actually regulated in the eyes of federal law.

    Legally it is a nonregulated rifle and can be sold face to face. No FFL, no MSP

    Anything beyond that is your choice. You may want to CYA since the MSP knows you have that lower.

    Given that it's one of my closest friends, I am 100% OK with transferring it to him in this way. A bill of sale and photocopy of DL will be used for my records of transfer.

    Many people suggest you do a firearm bill of sale and also attach info showing the HBAR barrel or HBAR upper if purchased as an assembly. Don't count on digging up emails or hoping its still on some website.

    Yep, definitely.

    The product description for the barrel is clear as day, described as both HBAR and Heavy Profile.

    Apologies for adding to this thread but is sort of similar. I have an Armalite AR10B. Bought it as an assembled rifle. Transferred to me by an FFL no 77R. Can I still sell this FTF to another MD resident? Thanks!

    Yes as of today. Might change in October.
