    Nothing in this country today is guaranteed except that the Dems will do everything in their power to destroy our Liberties and Freedoms. Damn the American citizen and everything to the illegals, whom will overwhelm our system economically, destroy American traditions, and try to turn the US into that wreck of a country they came from. Beautiful huh? Ican never understand when the illegals from south of our border, where everyone of them came from a failed Socialist country, and when they get here, what do they want/vote for? More Socialism. :sad20::mad54::tdown:
    Anyway, I'm quickly losing faith in our voting system, our State and local govts, Federal Govt, and now to include the court system as well.
    These are sad days for America.

    We knew this was going to happen when CA9 revolted over the Panel decision and went en banc. Wolf and Co. will have to appeal this ruling before going to SCOTUS. I feel this could stand a chance in the current SCOTUS composition...

    With the appeal timeline, then a SCOTUS application, wait, and (if taken up) the slow machinery there, that’s a multi-year snooze on the matter. The Dems will be doing everything they can to alter the SCOTUS landscape in that same long stretch. Maddening.

    Unless of course the appeals court overturns the 9th, and HI doesn’t want to run it up the supreme flagpole ... but even that first appeal will be a long time coming. Dammit.

    I think this was the 9th using their one last chance to drop a Baby Ruth in the swimming pool, two days before the SC considers cert for a second Clement-run NY carry case.

    We knew this when they went en banc in Peruta, to say there was no constitutional right for concealed carry.

    Young was looking good until the 9th went en banc again. To say the same thing for open carry.

    The SCOTUS will hopefully step in and say some form of carry is covered by the word "bear".

    Sounds fine in theory. In practice, the GOV can just keep escalating force until they ultimately prevail. Have anything in your safe that works against an A-10 or Apache?

    It’s a smug question. How’d that work out in Afghanistan? Do you believe every Apache and A-10 pilot/crew will all be on the side of tyrants? Do you think soldiers will all be willing to shoot their neighbors?

    The promise of a bullet in every member of the pilot's family for starters. This kind of crap has the potential to get real nasty, real quick and anyone with a functioning brain won't want escalate it.

    A hot CW2 holds no appeal for me at all.

    I think Clement will be busy tonight writing a brief for Scotus letting them know the 9th just ruled the right is home bound.

    I would motion for a rehearing based on the fact that they introduced a new argument at the en banc level that was not previously raised.

    Yes. They previously argued that intermediate scrutiny was the appropriate standard. They hired Neal Katyal who did a good job introducing a new argument primarily based on history and tradition. Nobody could really respond because all briefs were due at the same time.

    Nice observation. Does that go against the 9th cir. rules of procedure?
