    So this thread actually clears up a lot of questions I actually had as well... with the exception of one. So in MD you can't have an AR-15 type rifle chb in 5.56 with a 16" barrel unless its an HBAR, and has an OAL of 29" with the muzzle pinned/welded. However, you CAN have an SBR with a barrel >16, chb in 5.56, no pin or weld required as long as you properly register it. You can also have the same SBR, and call it a pistol by putting on an arm brace and it doesn't require any type of registration. I'm confused as the differences between the ballistic capability of each.. What's the point of the HBAR and Pistol brace?

    1) You cannot buy a lower out of state. The law requires the transaction to be legal in the state you are purchasing, PLUS your state of residence. Since MD treats the lower like a pistol (77R) you have to buy or transfer through a MD FFL.

    2) If you start with a pistol, when you bought it, it would be on a 77R and registered. If you bought just a lower, it would be on a 77R and registered.

    Also, if you buy a lower and make it into a rifle, you may never make it into a pistol.

    If you build it as a pistol, then you can change it to a rifle and back.

    These are Federal laws, not MD (except the 77R and registration).

    How do piston uppers play into the HBAR laws? Since they don't share parts with DI uppers, can I slap a 5.56 normal barrel profile piston upper onto a post 2013 lower?

    ComBloc is correct. Piston driven upper ARs are not required to have HBARs as they are not “parts interchangeable” with an AR15. Wolf actually makes a really cool T91 upper that is piston driven.

    I purchased an AR10 from PA, cash and carry, no involvement with any MD FFL whatsoever.

    If you build an AR to fire 5.56/.223, it will have to have a heavy barrel, whether it is an 80% or serialized lower.

    If you build a .22 cal AR, it does not need to have a heavy barrel, nor does a 9mm, .40 S&W, .45 APC, 300 Blk, etc. It can be from a serialized lower or an 80% lower.


    A lower purchased in another state, assuming you purchased it legally as a resident of that state, might have to be 'registered' in Md. I'm not sure on this one point. There are people here who can give better information on that than I.


    AFAIK the M&P 15/22 is legal in Md. It is a dedicated rim fire.
    Does Maryland restrict the magazine on the M&P 15/22 to only 10 rounds?

    I’ll be picking up my first stripped lower at a MD FFL next week (ordered from out of state). The FFL confirmed they will be checking the ‘other’ box on the 4473. I do plan to build it into a pistol but I wasn’t aware I had to tell that to anyone. If I do build into a pistol AR do I have to notify MSP and have a 77R completed?

    Yup...

    If it aint going on the 4473 as "long gun" then the state of mary gets involved, wants their $10 donation, 7 day jail and to know where its home is so the eventual confiscation can be more orderly and efficient ;)

    Haha. I guess I misunderstood what folks were telling me on other threads. I guess it’s my job to call MSP or does FFL do it? But if I remember right no HQL is that correct?

    Go to MSP website, create account, and fill out 77R . Where it asks for HQL number , click on it , and you get a drop box with more options . Click on " Exempt- Reciever Only " . Complete rest of 77R . Within minutes you will recieve e-mail with a code number , the FFL uses that on his portion of 77R at time of sale .

    You may do this in advance to save time at the dealer , otherwise virtually every dealer has a courtesy laptop for customer use .

    They ask you to "voluntarily" register your handgun/pistol/regulated firearm after you build it.

    How To Apply

    The Maryland State Police Application and Affidavit to Purchase a Regulated Firearm (MSP 77R) can ONLY be completed through the Licensing Portal. Before beginning your 77R application you will need to create an account with a valid email address. Creating an account assists us with verifying your identity and ensures the safety of your personal demographics. Once you have created your account you will be able to log in to start your 77R application.

    Upon submission of your 77R application you will receive a confirmation email with your application number and PIN number. Bring both items (application number and PIN number) to a licensed Maryland Regulated Firearm Dealer or to a Maryland State Police Barrack to complete the application process.

    The Dealer/Barrack will complete the application and submit it to Licensing Division. On the 8th day after the application has been submitted to Licensing Division by the Dealer or Barrack you will receive an email notifying you of your final disposition.

    If the notification email states your final disposition is Not Disapproved or Initial Review Not Disapproved this means that you have been approved and can now pick up your weapon. However if the notification email states your final disposition is Disapproved then you may contact the Maryland State Police for more information on the Disapproval; no further details will be provided in the notification email.

    If you’re picking up a stripped lower it should be on a 77R, not a 4473. Once you pick up the lower, you don’t need to tell MD anything. You may build it into an AR pistol or a MD compliant AR, they don’t need to know which nor should you tell them.

    As you’ll see in a previous post (Stating I only need 77R) do I need to complete a 4473 as well? The 4473 has three boxes, handgun, long gun, other. Under other it states receiver as one of the options. I thought this form was used for all FFL transfers.

    You will fill out a 4473 , but not recieve a separate NICS , that is included in the 77R process .

    Unless they improved the website since my most recent handgun , the trickiest part is the drop box for Exempted . There isn't an icon to indicate it's there. You have to already know, thru me off for a while the first time until I enquired on MDS .
