    That item 5 is straight from the CFRs.

    HAM is for educational purposes with a secondary use of emergency comms.

    If you are referring to;

    "Part 97.113 (5) Communications, on a regular basis, which could reasonably be furnished alternatively through other radio services."

    That rule is a bit ambiguous. The real intent for this rule is that you can use amateur radio to assist other services in a special event or emergency, but you cannot use amateur radio for that same purpose on a regular basis. Example: Helping out the public safety personnel in a fire, flood or rescue is OK, but Amateur Radio can't be their regular, primary means of communication.

    If FEMA was a serious organization, they’d have this information laid out for people to easily learn and apply. It’s crazy to me that the government rules the airwaves yet won’t make navigation simple.
    FEMA is a serious agency and has their hands full with many programs including COG plans…but they have ZERO control over airwaves….that is in the purview of the FCC in ALL cases
