Call DNR police tell them the story about how it was likey a bad shot from a hunter or a road hit that made it a ways before dying, and ask them if you can get a non-hunting tag for it (what they give you for a roadkill). Or if you know any other cops, they can write up a tag for you ( same exact tag). If they have any of these tags...some do, some don't. I think MSP would be more likely to have them.

In most cases, if you just want the antlers to decorate your barn wall, DNR probably wouldn't even care. They wouldn't send anyone out to investigate a bunch of dead bucks ( about 7) when someone called about them. Nor did they want to send a biologist to pick up a dead button buck that died mysteriously ( I think the caller maybe mentioned CWD and that got someone sent?) I guess they were too busy harassing trappers?

Those who shed hunt call these found buck skulls "dead heads". They are often partly nature cleaned up by shed "season".

This is from the same section of the code that I quoted earlier:

    (e) Checking and weighing deer at station before removing head or hide; prima facie evidence of violation. -- A person may not remove the head or hide or any part from any deer, except internal organs, or cut the meat into parts until the deer has been checked by the Department or 1 of the Department's agents at a designated checking station. Removal of the head or the hide of any deer not checked at a designated checking station shall be prima facie evidence that the deer was hunted illegally. Each separate deer or part of any deer taken illegally or found in possession shall be considered a separate offense.

I took the Hunter Safety class at Mt. Airy IWLA a couple of months ago. The LEOs teaching the class cited this as an example of "what not to do." They didn't get into why harvesting chunks of roadkill was such a big deal, but I suspect it's indistinguishable from poaching (so they treat it as such.) They indicated that there was a process for obtaining a roadkill tag for an animal you hit, but just being opportunistic was a no-no.

You would need to have a crap load of evidence supporting the fact that you did not illegally hunt the deer. Merely possessing untagged deer parts is prima facie evidence of illegal hunting. Think I would get DNR's blessing on that deer before touching it.

Where might one find a designated checking station?

Yesterday, my son and his grandfather happened upon a dead buck in the stone row of a field. Neither were hunting, but metal detecting with permission from the property owner. It looks like it was shot but ran? What are the Maryland laws about taking the rack, but leaving the dead deer?

What kind of size rack are you talking about? Find a hunter who is willing to put the dead buck on his tag. Not sure he would be willing to give up the rack though. You can take the rack and have it remounted on a old mount; or just cape out the deer and have it mounted. You can also boil the skull for a skull rack mount.

We don't have checking stations for deer or turkey anymore. You now tag in the field and have 24 hours to call in or use the DNR check-in website to get your confirmation #.

Camping in WV we ran into a couple sick deer we had to put down. They didn't run, came right to us when they heard us shooting, looked like zombies. I honestly believe they wanted us to put them down.[/QUOTE]

Can you legally do this? Did you have the OK from the local Game Warden?

I think defending yourself from ZombieDeer is just fine, but I could be wrong.

The property owner can go online and claim it, they do not need a license.

I know you do NOT want to get caught with deer parts in your possession without having a valid tag for the deer.

THIS:thumbsup: There are even cases of DNR charging knife makers who cannot prove they either killed or bought antlers used for handles.
