Don't understand how you can't have loaded firearms in your home if they are locked away. Smh. What's the point? This just stinks all the way around. Somehow I don't believe all the facts are being reported either.

    Confiscation

Well, this is how it starts. Pick someone who has marginalized themselves and they can say, see how well it works when we can confiscate these things. Anyone want to bet the devices they found were not auto-sears but SlideFires?

Okay outside the conjecture on the gunsmithing licence expiring, and not some much the alledged machine gun parts in possesion (serious and cause for charge admittedly), what is the crime here?

Is there a limit to the number of firearms one can posses in NY now?

Divide and conquer. This gun owner has too many guns...that gun owner has military-type guns...the other gun owner lives near a school...that one likes girlie mags...that gun nut over there cheats on her husband...here's a gun owner whose wife sought help from a psychologist...and this gun owner owes back taxes and drinks big gulps of sugary soda! So long as we find ways to discredit fellow gun owners and discount/justify gun seizures, it will be all the easier to turn up the threshold of what we will endure in the name of law enforcement. This is not to say some people do not deserve to lose the right of ownership, but that we are going to see more and more BULL$HIT cases on trumped-up cause as the gun-banners ratchet up their efforts...and make no mistake by thinking they won't.

The title of this thread is misleading. This is far from gun grabbing, house to house " confiscation" that many here like to argue and opine about in the current climate.

Make enough laws and soon all gun owners will be possesing illeagal firearms. He should not have let his FFL expire, that is his fault. Never let a good gun bust go to waste in this environment!

    Found another article.

"He was arrested in January on criminal weapons possessions charges and prosecutors announced the case Thursday after crime lab investigators completed testing on the illegal weapons found in the house, the Long Island Press reported Friday.

"Most of the guns recovered from this defendant's home were not under lock and key," Spota said. "We found them scattered among various rooms in the house and in an unlocked attic."

He added investigators found two devices called "drop-in auto sears," small pieces of metal used to convert AR-15 assault rifles into fully automatic machine guns.

Do you need to be a FFL to be a gunsmith? While his FFL lapsed 10 years ago, it looks like he was not selling, just smithing. What licenses do you need in NYS to be a 'smith?

Google is your friend; apparently you DO have to have a license in NY to be a gunsmith, no surprise there......
Looks like this guy broke all kinds of state and federal laws. Lets refrain from jumping on the 'gun confiscation begins' bandwagon just yet. I realize this is New York, but let's keep it real. This guy is apparently NOT a law-abiding gun owner and makes those of us who are look bad, especially in these times.

    New York State Gunsmith Laws

Gunsmiths in New York follow laws related to permitting and business operations.

In the New York State Penal Code, a gunsmith is defined as "any person, firm, partnership, corporation or company who engages in the business of repairing, altering, assembling, manufacturing, cleaning, polishing, engraving or trueing, or who performs any mechanical operation" on firearms.

The New York State Police has a special bureau for handgun commerce. This group regulates and monitors handgun sales, permits, transaction records and other commerce related to firearms. The laws that they enforce affect gunsmiths in several ways, including packaging and operations.

    Requirements to Become a Gunsmith

    Federal License
Gunsmiths working in New York must adhere to the federal requirements established by the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF). Anyone who repairs, engraves, or otherwise works directly with firearms in exchange for compensation is considered a "dealer" and must be licensed as such. Firearms left overnight for repairs with a gunsmith must be logged in a permanent "bound book." In some instances, repairs must be reported to the agency using ATF Form 5.

Here's the only thing folks need to learn.....and some of you in Md better be prepared to learn and apply this lesson fast.......

If you don't like the gun laws in your state.....MOVE to a state that is more amenable to your rights.

Its not like there's a shortage of states with good laws.

Its time folks started thinking hard about putting their money where their morals are and starving states that trample their rights.

The beast WILL starve and collapse if enough people vote with their feet and wallets.

You really think that ANY investigating BATF agent does not know what an auto sear looks like? You're grasping.

Dunno. In the linked-to story, they have a short news video showing the alleged "drop-in auto sear". What does it look like to you?

Since an auto sear for a post '86 AR is illegal you can't buy them as a civilian. If they really are auto sears, how did he get them? Also, as I understand it civilian semi autos are specifically designed not to accept them, so how can they be characterized as "drop in"?

    Yes, and answered above.

Exactly. All the State/Local NY LEOs have to do it get someone from a BATFE Field Office to assist the investigation and identify a controlled part.

Yes its a DIAS (Drop In Auto Sear) and YES they fit in a Semi Auto AR15 with no Mods as long as its a low shelf lower (Which almost all are except BAN Era Colts).
