I found a pretty good deal on a M&P 15-22 (comes with 25 round mag), which is legal to own in MD. The issue the online retailer won't ship it to a PA FFL, to handle the transfer, because I listed my address as Maryland. I didn't speak with anyone there as I was looking to do this through their website. If I change my primary address to my buddy's place in PA, it allows me to order.

Would it be unethical for me to use my buddy's address so they allow the sale? It's not like I'd be breaking any laws since the rifle is legal to own in MD, even the mag is as long as I pick it up out of State. Of which I would be doing by using a FFL in PA.

Has anyone done what I'm thinking of doing?

BTW, my buddy has no issues with me using his address.

Will you run into a problem with your CC? Billing address and the PA address won't agree? Might be easier to giv you friend the money and let him order it for you, I would run this by the PA FFL first though so he doesn't think your buddy's trying some straw purchase thing

It smells a lot like fraud to me. Probably breaks some interstate commerce laws as well. I suggest you don't do it.

I haven't tried to checkout, but the way the form is, I could plug in anyone's name and billing address for the credit card.

    That's a stray purchase right there !

Best answer - Have your prefered Pennsylvania FFL order it for you .
The transfer isn't taking place at that point. Who cares how payment is made when he goes to pick it up he'll fill out the 4473. But your idea to have that FFL order it is probably the best solution

If you meant, Straw, how is it a straw purchase, if it's me buying the gun for myself? It's just the online retailer has a goofy rule where they won't ship based on my primary address.

As for the FFL, I've never used them before. I only emailed them today to see if they would handle a long gun transfer for an MD resident, which they said they didn't have a problem with. I guess I should just drop in since they're close enough. I live less than 10 mins from the MD/PA border.

Somebody invents the word straw, probably a Democrat. Everybody is legal to buy and own, law abiding citizens exercising their 2nd Amendment rights.
The buyer is legal to purchase, the gun legal to own. More laws to make an honest person a criminal.

When you factor in shipping and transfer fees, you may be better off going directly through the FFL. They might even have it on their shelf. Even if it’s a few bucks more, you’ll be supporting a LGS which is always good in my eyes

Please do not complain about the retailer for being cautious. Same with the PA FFL. We live in a state with awful unconstitutional gun laws. We do have an unusual loophole that allows us to buy regular capacity magazines outside MD and legally bring them into the state. No reason some retailer should even try to figure this out. My guess is that ordering it through the PA dealer will cost you more money vs a transfer fee. I am working through the same issue with a S&W centerfire carbine. We simply have to accept that due to our decision to live in this liberal S-hole we are going to pay more for our guns and ammo.

This sounds like a viable option, but I have one question; can the Pa FFL transfer the gun to a Md resident? I've lost track of the adjoining states laws.

    Ethical?

How about is it legal? The letter of the law and the interpretation (right, wrong or otherwise) of the law are pretty important.

While you didn’t ask, it absolutely is INFRINGEMENT. Just. Like. They. Want.

Getting potentially legal opinions on the Internet. Priceless.

    Yes .
The gun itself is Maryland legal . But from a Maryland FFL would come with either a 10 round magazine , or no mag . The pickup from a Pa ( or other free state FFL ) is a work around to get the original 25rd mag for no extra charge .
