Eyes look like he may have "forgotten" he ordered his munchies.

Oh well, can't defend his actions.

The problem starts with him answering the door in boxer shorts.

Would it have been better if he was nude?? :lol2:

I'm guessing the rifle will be held for evidence then destroyed.

Most likely, since he'll likely be convicted.

Do they let you get dressed before they cart you off to jail?

    No.

Guy's obviously a dumbass, but can you talk about trumped up charges?

Brandishing a lethal weapon, guy earned that one.

Pointing a finger at somebody can be an assault.. Just saying.

    Pretty much.

What trumped up charges? He owns a big evil gun. He's obviously a nut-job that needs to be locked up. :sarcasm:

Although, I will admit, answering your door in boxers and a rifle is a bit weird.

Answering the door in your boxers, OK.

Answering the door in your boxers and leveling a rifle at someone, NOT OK.

So is it a crime b/c he pointed it? I answer the door all the time with a sidearm on my hip. AFAIK, that's perfectly legal. Seems a little murky...
    Two different..

You having a sidearm doesn't constitute a threat.

Now if you pointed the said gun at a bystander.. The person can file an assault against you. Believe this is what happened in this case.

Not an expert, but the criminal investigation started with the "victim" stating man at house pointing rifle at him. Gave description of suspect.

Reasonable suspicion led to Police lawfully walking up to talk to the suspect at his house, suspect had same description to include a rifle.

Probably cause led to being detained and taking a ride/being charged.

Now its up to the Judicial system.

    I've seen the First 48 a few times, How'd I do?

Since the guy didn't order a pizza*, someone obviously was setting him up.

How do we know someone hadn't been threatening and/or harrassing him, and this is why he answered the door with a firearm?

(edit: not justifying his pointing the rifle at someone, though...)

*edit #2-- I misread the article, and thought it said he "did not" place the order.
