Didn't lawyers and other "experts" here claim Mark Smith was wrong when he predicted this would go enbanc?

I'm pretty sure I remember that.

This fast tracks the inevitable, which is a loss for MD gun owners. SCOTUS will have to decide because the panel will NOT side with the 2A.

I would expect a really quick turn around at the SCOTUS.

The supremes would tell the 4CA en banc they got it wrong without oral argument because this would be the second time before the big court.

Not only was he correct, he predicted correctly that it would be decided without an opinion being issued by the three judge panel.

    Spot on for both counts

Bruen didn't, but Heller already did with the "In Common Use" test. And in Bruen, it was made clear than Heller was still good law and affirmed, not overturned.
Kolbe was the 4ca opinion of what Heller supposedly said. While it was clear that Bruen overruled the intermediate scrutiny analysis, it was unclear how Bruen affected the applicability of “assault weapons” in Kolbe since Bruen did not address that issue

I would have been surprised if Bruen had addressed it, because it wasn't one of the controversies brought for them to decide in that carry-centric case. SCOTUS just needs the appropriate vehicle to decide the "What hardware does the 2A actually cover?" issue.

Looks like the verbose YouTuber was correct.

Umm maybe. By his theory the en banc panel took it because the 3 judge panel was 2-1 pro 2A. How does that jive with a "pro 2A" panel, if he's correct and that is what it was, sitting on it for over a year and a half without making a decision?
