While it was clear that Bruen overruled the intermediate scrutiny analysis, it was unclear how Bruen affected the applicability of “assault weapons” in Kolbe since Bruen did not address that issueBruen didn't, but Heller already did with the "In Common Use" test. And in Bruen, it was made clear than Heller was still good law and affirmed, not overturned.

I would have been surprised if Bruen had addressed it, because it wasn't one of the controversies brought for them to decide in that carry-centric case. Umm maybe. By his theory the en banc panel took it because the 3 judge panel was 2-1 pro 2A. How does that jive with a "pro 2A" panel, if he's correct and that is what it was, sitting on it for over a year and a half without making a decision?Looks like the verbose YouTuber was correct.
