    IF I were the roofer I would drop all charges and refuse to testify. A stupid kid made a stupid mistake. I would not attempt to go after the kid. I don't care what anyone else would do but, I wouldn't want that to follow the kid for life. I would talk with his parents in earnest about it , but that is really going to hurt that boy even after he is grown.

    When kids "play" they do stupid things to each other (yes I was a victim, 3 pump max, below the waist, wearing jeans) but no third party adult was ever targeted. This kid gets what he deserves. Discharge of a firearm? No, but its still an unwanted touching or assault. Me, i probably wouldnt file charges if thought his parents would address it, but i wasn't on a 100 degree roof and shot by some dumb kid with a bb gun.

    When kids "play" they do stupid things to each other (yes I was a victim, 3 pump max, below the waist, wearing jeans) but no third party adult was ever targeted. This kid gets what he deserves. Discharge of a firearm? No, but its still an unwanted touching or assault. Me, i probably wouldnt file charges if thought his parents would address it, but i wasn't on a 100 degree roof and shot by some dumb kid with a bb gun.

    If the parents addressed it the way I think they should, they would be in jail also.
    Some one needs to put a .177 cal in his buttox.

    Me and my friends used to shoot at each other too. We had rules kinda - like not in the face, no more than two pumps, usually aiming at our winter coats. I remember one time I shot my friend in the behind right below his coat. He thought I did it on purpose (: - we fought for a few days but made up and remained friends.

    We were just dumb kids.

    Oh yeah, we used to do this all the time. Snowboarding jackets, jeans and our goggles (just in case :rolleyes:). I've had and given quite a few good bruises from a BB. Of course no random people were ever targeted...kid should definitely get in trouble for shooting a stranger, but don't ruin his life.

    Took some digging, but I think the City of Frederick does make the distinction between a "firearm" and a "BB gun."
    Sec. 15-17. Firearms—Discharge within city.

    It shall be unlawful for any person to fire, discharge or set off any gun, rifle, pistol, revolver or other firearms, air rifle, cannon, torpedo, squib or other dangerous weapon of any character within the city without a written permit from the chief of police and director of safety;

    Given the way this is worded, if you set off a torpedo in the brackish concrete downtown water feature, you would probably be charged with a Firearms Discharge offence, even though they don't consider a torpedo to be a firearm.

    It's still better than MoCo, where a rubber band on the end of your finger is considered to be a firearm. I actually used this example as well as the nail gun issue when presenting testimony against SB281 last year.

    Proper punishment would be to have the yoot haul materials up ladders for the roofer. The month of August would be a good duration ... and lesson.

    When I was in high school the Parcel Pick-up guy at the Grocery store I worked at used to get hit with blow darts all the time and imo is 100% worse than getting shot with a bb-gun.

    The kid probably doesn't even realize the restraint exercised by the roofer by not returning fire with his nail gun ;)

    Yeah I don't really get the targeting someone else thing. Friend and I used to just kill each other (bb guns, slingshots sorta quarter pull, bottle rockets). It was stupid and just plain fun. Never thought about hurting someone else though.

    I'd want the whole story too; first offense, good kid, etc I wouldn't want it to follow him.
