    Reading some of what King wrote, it's pretty apparent that he made his decisions based on his personal opinion about guns and not on the law. Shameful.

    The sad and dangerous part of your statement is that more and more judges and even justices are injecting personal and political feelings into their deliberations instead of straight up interpreting the constitution or existing laws and regulations. After Woolard, I'm not holding my breath but will be extremely pleased and surprised as I was today if we continue to win as this goes forward. I can only hope.

    I thought I saw some language in my first scan that might be applied to other aspects of FSA13, but it seems not to have borne out on a [more] thorough read.

    There are a lot of good statements in there. If this does not affect other parts of the FSA I am sure this document could be put to good use.

    If I were Frosh, that is what I would do too. Going for en banc is a no lose proposition for him. And he knows that he can't meet the strict scrutiny test. But he has a real problem. A "conflict" with other circuits over the standard is not the same thing as a conflict over the result. Theoretically he could win on remand. He can make all the same arguments in a second en banc petition if he loses after remand. Second, the panel majority is dead right that circuit precedent (Chester) requires strict scrutiny for "in the home" restrictions. So the panel is on sound ground there. So the split in the circuits on the standard is the pre existing split, not created by this decision. So that leaves SCT review and that's a long shot for him on a petition from interlocutory decision that merely ordered a remand. The SCT would rather rule on the basis of the full record created after remand, at least that is what I would argue in opposing cert. And yes, I would oppose cert., even though others would rather have a SCT decision on this now. Better to prove your case under strict scrutiny and then let *that* case go to the SCT after Frosh loses on remand.

    It's even sadder than that. He had a whole year to come up with his best argument, and the best he could do was "guns are yucky, look at this bloody shirt"

    Nope. They are being told the court is wrong and the law is constitutional.
    If, with all the testimony of 2013 they still passed it, no way in hell they will declare they were wrong. That's what is going to make them lose.

    That's better than a John Doe Grand Jurry, and the US District Court will be the arbiter. I'm sure the FBI would be VERY interested in those depositions. (Though Hillary is a bit of a priority these days).

    Got home m'self a couple hours ago, and this made for an interesting read post dinner. Not everyone gets to keep up to date on the issues during work (or 'for work' as may be the case for some of our advocates).

    I don't know if it's the cynical old fart in me or just experience in dealing with democRATs & libs, but I still don't feel good about this. I guess it's because of what's happened in the country the past 8 years, how so many things have gone against reason, logic, legality & plain common sense. I hope I'm wrong.
