    Lower court ruling upheld.


    I have always believed that the Second Amendment will be used as a bargaining chip.

    Will the Senate confirm a moderate SCJ based on an EO like this being floated by BHO?

    The power of SCOTUS comes from everyone obeying its rulings. Once that has been broken, SCOTUS is nothing. I forsee states ignoring SCOTUS on both sides of the isle - both conservative on abortion and gay marriage and liberal on gun rights.


    If that happens, things will crumble quickly....

    Obama will offer up the MOST polarizing nomination to replace Scalia.

    A Black, Hispanic, LBGT, Woman who worships the religion of peace ... to insure that the DemocRATS will use her confirmation refusal to initiate 'fundamental change' in the make-up of Congress during the 2016 election.

    As Rush would say ... "Don't Doubt Me !!!"

    Chris Plante is one of the most reasonable, well spoken minds on the radio today. Tells it like it is. If he ran for office, I'd help campaign for him.

    You are absolutely 100% correct. That's why it is so important for the Repub's to lay down the law very publicly NOW, across the board as to ANY nominee, before "its" [sic] identity is known, and be ready to very loudly and assertively point back to this point in time and the reasons.

    What prevents Obama from making a recess appointment of Schumer or Michelle to the Supreme Court? Can or would McConnell do what was needed to prevent a presidential recess appointment?

    Chief Justice Roberts has control of when things are heard. This will not happen.

    My guess is he will move to hear cases with circuit court rulings more favorable to conservatives. At least as long as he can.

    The current Congress's term expires on January 3, 2017, before the new Congress (and President) are sworn and take office on January 20, 2017. I don't believe that 17-day gap is a "recess." School is out.

    Let's hope Roberts doesn't start to feel heart attack-y. Under Stalin, a lot of the inner circle came down with heart attacks. It was a real outbreak.
