so what now? How does it square with 9ca?
This is definitely in our favor though. If cert is denied, things are looking good for us. Not so much other circuits, but it will be good for those in the 4th Circuit. Even if cert is granted, I like our odds with what I briefly read while scanning through this for the holding.

Didnt 9ca send a case like this back to district court where 4ca heard the case en banc? Would that create a split between the ca courts?
Yep, the e-mail notification I received had a link to the February 4, 2016 decision. I'll take everybody's word for it that we are getting the shaft today. Going to get back to work to try and alleviate this misery. What a roller coaster ride of emotions. Elated to pissed to sad.

Well, a cert petition to the SCT is next. Apples and oranges with respect to the 9th Circuit Peruta decision.
From a quick glance, it looks like the dissent tees up the “dangerous and unusual” (conjunctive vs. disjunctive) argument as the easiest to gain traction for cert.
All one has to read is the first sentence - retelling Sandy Hook - to know where this one was heading...
